Boston Criminal Defense Attorney

Boston Drug Crimes

The Boston Police Department, State Police, FBI, and the Drug Enforcment Administration (DEA) are all responsible for the investigation and enforcement of drug crimes in Boston. Some of the more common drug crimes are Possession with Intent to Distribute a Controlled Substance, Distribution of a Controlled Substance, and Trafficking. Trafficking can be charged if the weight of the drugs exceeds a specified amount (usually 14 grams). The penalties for various drug crimes depend on the type, or class of drug. There are many ways to defend a drug case. The first thing that should be examined is the initial stop and seizure of any physical evidence, and any statements made to law enforcement. If police used a search warrant, the warrant should be evaluated for any constitutional, technical, or procedural deficiencies. These issues will be argued in court at a Motion to Suppress Hearing. The chain of custody of the physical evidence must also be examined, along with the testing and analysis of the drugs. Attorney Hinman has extensive experience with search and seizure issues, and as a member of the Drug Unit in the District Attorney’s Office, was responsible for assisting in the authoring of search warrants.
